THE MEDIATION PROCESS:
Mediation is a process which supports all participants in changing the quality of their conflict from
negative to positive in order to support movement toward a resolution. Mediation assists the
participants in expressing feelings, clarifying information, assisting to better understand each other's
perspective, exploring alternatives, and making decisions. This is a confidential process which is not
legally binding but attempts to help both parties resolve a conflict in a respectful and supportive
manner. The mediator will not make decisions about “right and wrong” or determine how the
conflict should be resolved. If an agreement is reached, the mediator can prepare a Memorandum
of Understanding document outlining the decisions reached in the mediation. A mediator cannot
provide legal representation or legal advice.

During conflict, strong feelings such as anger, resentment, defensiveness, and fear block one's
ability to effectively communicate and resolve difficult issues. When communication breaks down,
problems remain unsolved, relationships rapidly deteriorate and conflict escalates. Professional
Mediation Associates can provide the support and guidance necessary to assist individuals,
couples, families, groups, organizations, and communities in facilitating constructive conversations
about the concerns that are important to them in order to resolve the conflict. Mediation can be less
contentious, less time consuming and less costly than the legal system. The goal is to help achieve
some understanding of each parties needs as a way to resolve the conflict and/or assist with legal
decisions. Mediation keeps the decisions in your hands.
